10th Amendment

Recent American (and Mexico) have been in a uproar over Arizona’s new bill to allow police officer’s ask for birth certificates so someone who they think my be illegal. The main reason why people hate this bill is because of racial profiling. America already dubs Middle Eastern people as “terrorist”. Giving those who are innocent a heavy burden they have brought son themselves. For instance if a driver stops a Latino man in his car and he believes that he is illegal he is able to ask the man for proof of citizen ship. The man must then produce his driver’s license, proof of insurance… and his birth certificate.

Unfortunately they were able to pass this bill because of the tenth amendment. That amendment allows them to make and pass laws not given in the constitution. Just like another state is able to pass a bill saying you must wear seatbelts at all times or another state banding dogs from schools. Each state has the ability to makes bills that will do the best for their citizens.

I personally find the bill appalling. I get the fact that there are too many illegal people coming into American and they need a way to get them out. It’s the possibility of racial profiling and harassments that I find crass. Geraldo Rivera interviewed Arizona Sheriff Joe Arpaio, and Latino Congressman Lincoln Diaz-Balart. When he asked the sheriff about what would be a sign that a person might be illegal he responded. "[D]uring the course of the duties of law enforcement, my deputies, if someone doesn't have a license, doesn't speak English, ten guys stashed in back of a van, I think that's reasonable action or probable cause to take action.". that is a common stereotype that is tagged with Mexican people. He already has a predetermined notion of what an “illegal” might look like, which will drive him to harass people who he believes fits his image of an illegal immigrant. No matter how much others hate the bill they do have the right to pass it. Why? Because it’s what they feel is best for the legal citizen of Arizona
